This page sets out the terms and conditions of use for this website including all of e-Studios Photo Restorations & Imagery's services. Any reference within these Terms and Conditions to “we”, “us” or “our” means "e-Studios Photo Restorations & Imagery".

You understand and agree that:

Using our services automatically constitutes an agreement and confirmation by you, that you accept and agree with our terms and conditions and our Privacy Policy. If you do not accept and agree with our terms and conditions and to our Privacy Policy, or wish to withdraw your consent, please do not use our services.

All photographs and images are covered by copyright laws. When submitting or forwarding any type of image to us, you accept full responsibility for all copyright related issues by either ensuring that you own the copyright for the image, or have obtained all necessary rights and permissions from the rightful copyright owner for you to use the image and for you to authorize us to work on the image. Furthermore, as part of your accepting full responsibility for all copyright related issues, you also confirm and agree to defend and indemnify us from all expenses and liability should that arise from our performing work on the image/s supplied.

Once we commence working on your image, all title and usage rights of the modified image belongs solely to e-Studios Photo Restorations & Imagery. The right for you to use the modified image only comes into effect once full payment of the invoice has been made. In other words, you do not have the right to use the modified image until full and final payment is made.

The download or upload of any material through our systems is done at your own discretion and you agree to be solely responsible for any loss or damage to your files, software programs, computer system or data resulting from the download or upload of any material.

Once you accept our quote and submit an "order confirmation" via email, you are agreeing that you are fully satisfied with the quote. You also understand and agree that that the instructions outlined in the quote serves as a formal and binding contract of what your instructions are and what is the limit of your instructions.

Any sample image/s made available to you are for your inspection only and are protected by copyright laws and regulations.

Once we forward you the completed work to you, it is your responsibility to ensure that you create a copy of the work on your own system. In most cases this will mean that you copy the image file/s onto your own computer or image storage device or facility and make the necessary steps to keep them safe.

We do not guarantee you access to the completed work for more than four (4) weeks after the date of informing you via email, that our completed work has been made available to you. Therefore, please be sure to download and store your image files on your computer or chosen storage facility within the said timeframe.

In cases where we have obtained consent from you, confirmed via email, to post one or more of your images on our website, we reserve the right to use and alter that image at our discretion.

Furthermore:

You agree to not use our services to upload, post, email, transmit or make available any content that is unlawful, illegal, abusive, malicious, unethically or otherwise objectionable. You also agree to not use a false e-mail address, impersonate any person or entity and that all processing information that you submit is accurate. e-Studios Photo Restorations & Imagery reserve the right to report any unlawful use or abuse to the relevant authorities without any prior notice.

By placing an order with us you affirm that you are 18 years of age or older. If you are under 18 years of age, you may ask a parent or a legal guardian to place the order on your behalf. In accordance with PayPal, our online payment service provider, an individual must be of the legal contract age before he or she can enter into a binding legal agreement known as a contract. Therefore, e-Studios Photo Restorations & Imagery does not accept orders from customers under eighteen (18) years of age.

We advise all potential and existing customers not to post any orders, images or personal information on any social media sites (including ours). Be aware that all posts on social media may be publicly viewed by everyone and may be potentially misused for fraudulent activities.

We reserve the right to terminate the access of any person to our system and services, at our discretion.

These Terms and Conditions policies may change from time to time so please check back periodically. We reserve the right to change our rates and fees and modify our Terms and Conditions and Privacy Policy, at any time, for any reason, at our discretion.
